THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITE, APPLICATIONS, FEATURES, AND SERVICES PROVIDED BY PIXORUM (COLLECTIVELY, THE "SERVICE"). BY USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.

Acceptance of Terms
The Service is offered subject to your acceptance of these Terms and any modifications made by Pixorum. By using the Service, you confirm that you are at least 18 years of age or the legal age of majority in your jurisdiction. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

Rules and Conduct
You agree to use the Service only for lawful and ethical purposes. You agree not to:
• Upload or process any content depicting or involving minors (under 18).
• Upload illegal, pornographic, hateful, violent, misleading, or defamatory content.
• Upload content without the express written consent of any person depicted.
• Generate false photography or documentation.
• Impersonate others or mislead others about your identity.
• Interfere with, reverse-engineer, or exploit the platform or models used.
All inputs and outputs are sent to Replicate’s AI infrastructure, and Replicate may store and use them to improve their services, as detailed in their Terms of Use.

License and Ownership
By using the Service:
• You are granted a non-exclusive, limited license to access the platform.
• You own the output images you generate, subject to third-party license terms (including those of Replicate).
• You grant Pixorum and its infrastructure partners a royalty-free license to use, store, and transmit your inputs/outputs for service delivery, quality control, diagnostics, and legal compliance.

Credits and Subscriptions
• The platform uses credits to process images. These credits are either granted during trials, purchased one-time (PAYG), or included in subscriptions.
• Each image job consumes credits. Credits are deducted once a job is submitted—no refunds for failed or unsatisfactory outputs.
• All sales are final. There are no refunds for consumed or unused credits.
• Subscriptions renew automatically unless canceled before renewal.
• One free trial per user; misuse (e.g., creating multiple accounts) may result in account termination.

Payments and Billing
• All payments are processed via Stripe. We do not store your payment information.
• Prices are listed in USD and may change with notice.
• Applicable taxes may be added based on your location.
• You agree that Pixorum provides you immediate access to digital content and begins service consumption immediately upon purchase, without the standard 14-day withdrawal period. Therefore, you expressly waive your right to withdraw from this purchase. Due to the high costs of GPU processing, we're not able to offer refunds because we reserve servers and incur high costs for your usage immediately. The subscription will be automatically renewed for the same period of time after the agreed term. If you do not wish to renew your subscription in the end of the term, you should cancel prior to the renewal date of your subscription.
Pixorum offers a paid Service. You can sign up for a monthly or yearly subscription, that will automatically renew on a monthly or yearly basis. You can stop using the Service and cancel your subscription at any time through the website (click Account). If you cancel your subscription, you will not receive a refund or credit for any amounts that have already been billed or paid. Pixorum reserves the right to change its prices and offering (like credits or models) at any time. If you are on a subscription plan, changes to pricing will not apply until your next renewal.
Unless otherwise stated, your subscription fees (“Fees”) do not include federal, state, local, and foreign taxes, duties, and other similar assessments (“Taxes”). You are responsible for all Taxes associated with your purchase and we may invoice you for such Taxes. You agree to timely pay such Taxes and provide us with documentation showing the payment or additional evidence that we may reasonably require. If any amount of your Fees are past due, we may suspend your access to the Services after we provide you written notice of late payment. You may not create more than one account to benefit from the Free tier of our Services. If we believe you are not using the Free tier in good faith, we may charge you standard fees or stop providing access to the Services.

Referral and Affiliate Program
• Only new users may apply a referral code.
• If valid, both referrer and new user receive bonus credits.
• Users cannot refer themselves or reuse codes.
• We reserve the right to revoke affiliate benefits in case of misuse.

• Email, username, hashed password, and Google OAuth identifiers
• Uploaded images and processed outputs
• IP address, usage logs, device metadata
• Stripe identifiers and billing history
Use of Data
• To provide the Service and process images via Replicate

• To enforce terms and prevent fraud
Sharing of Data
• Your inputs/outputs are shared with Replicate for processing and may be retained by them per their terms.
• Stripe processes all payment data.
• No personal data is sold or shared with other parties except as required by law.
User Rights
Under GDPR and similar laws, you may:
• Request access, correction, or deletion of your data
• Request data portability
• Object to certain uses

Pixorum does not manually review all content submitted or generated by users. Users are solely responsible for all content they upload, submit, or create using the Service.

Arbitration and Class Action Waiver
To the fullest extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to this Agreement or your use of the Service shall be resolved by final and binding arbitration under the rules of the Spanish Arbitration Club. You and Pixorum agree that:
• All disputes will be resolved individually and not in a class action or consolidated proceeding.
• You waive any right to a trial by jury.

DMCA & Takedown Policy

Termination
Pixorum may suspend or terminate your account if you violate these Terms. Termination includes revoking access and deleting related data and credits. No refunds will be issued.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXORUM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. DIRECT LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE LAST SIX MONTHS OR $100, WHICHEVER IS LOWER.

Jurisdiction and Legal Venue
These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts in Madrid.
